CakeResume” (hereinafter referred to as “CakeResume”) is a service provided by Trantor Tech, Inc. (hereinafter referred to as “the company” or “we” or “us”). We value the personal information protection of the users (including “Visitor” and “Member”, hereinafter referred to as “you” or “users”) of our services. This Privacy Policy outlines how we collect and use different types of personal and behavioral information, and reasons for doing so, complying with applicable regulations including California Consumer Privacy Act (hereinafter referred to as “CCPA”), General Data Protection Regulation (hereinafter referred to as “GDPR”), and Taiwan Personal Data Protection Act.

We provide our services via CakeResume website and CakeResume App (hereinafter referred to as “Services”) to users. This Privacy Policy applies to any access to our Services. By clicking “Build My Resume Now,”“Search Job,”“Sign Up” or similar, registering, accessing, or using our Services, you are agreeing to enter a legally binding contract with us (even if you are using our Services on behalf of a company). You may read this Privacy Policy in conjunction with our Terms of Service to totally understand how we collect and use personal information.

We may modify this Privacy Policy in relation to changes in the law, best practice, or changes in our Services. We will provide notice of the material changes through our Services and publish the updated policy on our website. Your continued use of our Services means that you are consenting to the updated terms as of its effective date (the date of the publishment date of the updated Privacy Policy on our website). If you object to any changes, you may stop using our Services and we may stop providing Services accordingly without indemnification or any liability to you.

1.      Information We Collect

If you create an account or log in with other account and use the Services, we will collect necessary personal information provided below:

(1)     Information You Provide to Us

When using the following services, you provide personal information to us

A.      Registration

I.         To create an account of Member, you need to provide personal information including your name, email address. You can choose not to provide other personal information in your profile which may limit your ability to use some functions in our Services.

II.       You can also choose to log in with your Facebook, Twitter, Google, or Apple account and we will receive the following personal information from these accounts:

       Username;

       E-mail address; and

       Photo (Only provided by Facebook, Twitter, Apple)

B.      Profile and Resume

When you apply for a job in the Services, you will provide profile and resume. You have choices about the information on your profile and resume, such as your education, work experience, or skills, and such additional information may help you to get more from our Services, including helping recruiters to find you.

It’s your choice whether to include sensitive information (e.g., racial, or ethnic origin, political opinions, and religious belief) on your profile and resume and to make that sensitive information public.

Please do not post or add the personal information that you would not want to be public on your profile and resume on CakeResume.

You may change the settings of your account to restrict who may review your profile. In addition, if you don't want your resume to be appeared in the search results of Google search engine, you can also find the method to change the settings in the FAQ to make it visible only to those with the link of your resume or any employer users on CakeResume.

C.      Information from Other Application

On our Community page, you can choose whether to link to your contacts, connect with people you know from other account (i.e., Google, Slack or Outlook account) to follow their career activities on CakeResume. By linking to these accounts, we will receive the email addresses of your contacts in these accounts to show you the person in your contact using our Services, but we will not store email addresses of these contacts.

D.      Pricing Plan

If you purchase our pricing plan, you will provide payment information to the third-party online payment system. Online payment is completely processed by the third-party online payment system. We will only receive and store your purchase record, including payment amount and purchase items, but will not store your credit card number.

E.       Other Information

We collect all your interactive information across our Services and the information you voluntarily provide. Please note that our Services is a public platform, any information (e.g. comments, files, messages, community posts, post likes) that you share across our Service may be accessed by other third parties. The information collected will be used to enhance your overall experience with our Services.

(2)     Cookies and Similar Technologies

When you use the Services, (e.g., browsing or clicking content, searching, sharing articles, or applying for jobs), we will record your behavioral information, including IP address, Cookies, Device ID (device model and device system information) to recognize you and record your behavior.

A.      Technologies

I.         Cookies: A cookie is a small file placed onto your device that enables CakeResume features and functionality. Some of the Cookies are strictly necessary for the functionality of the website or the app while others are used to enhance the performance and your user experience. Any browser visiting our Services may receive Cookies from us. Some Cookies are temporary and will disappear when you close your browser, others are persistent and will stay on your computer or mobile phone for some time. We use the following types of Cookies.

                   i.            Essential: These are Cookies that are required for the regular operation of our websites. For example, some Cookies allow us to ensure that people can access our Services in the correct region and language for them or carry out fraud detection and security checks. These are essential for the website to work properly.

                 ii.            Functional: These remember your preferences and are intended to make your experience on our Services better for you. For example, a functional Cookie is used to remember your log-in details securely, which makes it possible for you to return to our websites without having to log in every time.

                iii.            Analytics: These Cookies are used for performance measurement to understand things including how many people visit our websites, how they navigate our websites, and what content is popular. This allows us to improve your experience with us.

                iv.            Security and Services Integrity: We use Cookies to help us keep your account and data safe. For example: Cookies can help us identify and impose additional security measures when someone may be attempting to access your account without authorization, for instance, by rapidly guessing different passwords. We also use Cookies to store information that allows us to recover your account if you forget your password or to require additional authentication if you tell us that your account has been hacked.

II.       Pixel: A pixel is a tiny image that may be embedded within web pages and emails, requiring a call that will be recorded to our servers for the pixel to be rendered in those web pages and emails. We use pixels to learn more about your interactions with email content or web content (e.g., whether you interacted with posts). Pixels can also enable us and third parties to place Cookies on your browser.

III.     Local storage: Local storage enables a website to store information locally on your device. Therefore, the data will not disappear even if you close the paging or reopen the browser. Local storage may be used to improve the CakeResume experience, for example, by remembering your preferences, so that you do not need to set up next time and make the Services experience smoother.

B.      Your Choices

Most web browsers set Cookies and can be set to disable the use of Cookies, which will be used to indicate your consent to the use of Cookies. If you wish to disable the use of certain Cookies or disable your browser from receiving Cookies, please refer to your browser vendor’s instructions by clicking “Help” in your browser menu.

If you choose not to use cookies during your visit, you should be aware that certain functions and pages will not work as expected. You may worsen your overall user experience since it may no longer be personalized to you. It may also stop you from saving customized settings like login information.

(3)     Your Device and Location

If you use CakeResume App from a mobile device, that device will send us information about your location based on your device settings. We will ask you to opt-in before we use GPS or other tools to identify your precise location.

We will not share your current location with other users. If you do not want us to get your location, you should turn off the location services for the mobile application located in your account settings or in your mobile device settings.

 

2.      How We Use Your Information

How we use your personal information will depend on which Services you use, how you use those Services and the choices you make in your settings. We primarily use your information for the purpose of providing personalized Services and advertisement on things we think you may be interested in.

(1)     Services

You agree that CakeResume use your personal information and the inferences we make from your personal information, to provide and personalize our Services. For example, recommending or ranking relevant contents or suggestions in the “Talent Search Service”, “Job Search Service” and “Community” of the Services (Art. 6 para. 1 lit. a GDPR).

If you do not want us to collect your behavioral information through your interactions on the Services, you can change the collecting behavior of the Services through Settings.

(2)     Pricing Plan

For Members who subscribe “Talent Search Pricing Plan,” they can use the exclusive functions complying with this Privacy Policy, such as searching all resumes (aside from public resumes, subscribers can also search resumes that are only public on CakeResume), viewing other users’ email addresses and phone numbers and storing these information (Art. 6 para. 1 lit. a GDPR).

Provide your phone number or other contact information in your profile may help you better connect to recruiters subscribing the Pricing Plan and get more opportunities through our Services.

(3)     Communications

You agree that we contact you through the personal information you provide, such as email, phone, and notice from the CakeResume website or APP, messages sent to your CakeResume inbox, and other means provided by the Services.

Please be aware that you can opt out of receiving service notice, not including security and legal notices, from us at any time by changing the notice setting.

We also enable communications between you and others through our Services (Art. 6 para. 1 lit. a GDPR).

(4)     Personalized Advertising

You agree that we use the following information, whether separately or combined, to provide personalized advertising such as the talent recruitment activities, internship clubs and other relevant information by sending email to you. If you do not want to receive relevant information, you can tap the “unsubscribe” button at the bottom of the email (Art. 6 para. 1 lit. a GDPR):

A.       Member-provided information (e.g., profile, contact information, title, and industry);

B.       Information from your use of our Services (e.g., search history, feed, content you read, who you follow or is following you, connections, page visits, etc.); and

C.      Data inferred from the information described above (e.g., using job titles from a profile to infer industry, seniority, and compensation bracket; using your feed activity to infer your interests).

(5)     Developing Services

We use personal information to conduct  research  and development for our Services in order to provide users with a better, more intuitive and personalized experience. We may collect information such as IP address to monitor and analyze the usage of the Services, so that we can improve the function of the Services. The processing required within this context serves our legitimate interest to continuously improve our Services (Art. 6 para. 1 lit. f GDPR).

(6)     Customer Support

We use personal information, which can include your communications, to investigate, respond to and resolve complaints and for service issues (Art. 6 para. 1 lit. b GDPR).

(7)     Research

We use your personal information to produce and share insights that do not identify you. For example, we may use your personal information to generate statistics about our members, their profession or industry, or to create demographic workforce insights. The processing required within this context serves our legitimate interests in academic research (Art. 6 para. 1 lit. f GDPR).

(8)     Legal Disclosures

We may need to disclose your personal information when we believe it’s required by law (e.g., requested under subpoena or other legal process) or to help protect the rights and safety of you, us, or others, including to:

a.       investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies;

b.       enforce our contract with you;

c.        investigate and defend ourselves against any third-party claims or allegations;

d.       protect the security or integrity of our Services; or

e.       exercise or protect the rights and safety of CakeResume, our Members, personnel or others.

We attempt to notify Members about legal demands for their personal information when appropriate in our judgment, unless prohibited by law or court order or the request is an emergency (Art. 6 para. 1 lit. c GDPR).

(9)     Other Uses of Your Information

As part of the further development of our business, it may happen that our structure changes by changing the legal form or founding subsidiaries. In such transactions, customer information may pass on together with the part of the company to be transferred. Whenever personal information is disclosed to third parties to the extent described above, unless with your consent, we will ensure that this is done in accordance with this Privacy Policy and the relevant data protection laws.

Any disclosure of personal information is justified by the fact that we have a legitimate interest in adapting our corporate form to the economic and legal circumstances as necessary (Art. 6 para. 1 lit. f GDPR).

 

3.      How We Work with Third Parties

We use third parties assisting us in providing our Services or improving your user experience, including payment, email, hosting our website, storage, and survey. These services providers will have access to your personal information as necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.

(1)     Payment

When you make a payment on our Services, your payment will be processed by a third-party specialist payment processor to ensure a secure transaction. All payment processors used by CakeResume are compliant with required security standards. The personal information provided during your payment will be forwarded to the respective banks or financial institutions for the purpose of processing the payment. In the case of payments by credit card, we only receive the information that a payment has or has not been made. We therefore have no knowledge of your credit card number.

For the processing of payments by credit card, we use the service provider Heroku, Inc., based in Virginia, USA.

(2)     Email

We send you an email through third-party service providers. For sending emails, we use the service provider Heroku, Inc., based in Virginia, USA.

(3)     Hosting of Our Website

For the hosting of our website, we use the services of Amazon Web Services EMEA S.a.r.l., based in Virginia and California, Singapore, South Korea, and Japan.

(4)     Storage

For data storage, we use the services of Google, Inc., based in the USA.

(5)     Survey

We send surveys to you and collect responses through Google, Inc., based in the USA, and 25sprout, LLC., based in Taiwan.

Please note that the above contractually affiliated third-party companies and service providers might be changed from time to time based on our business cooperation.

 

4.      Retaining and Storing Your Information

As long as your account is still in use, or needed to provide you with Services, we will keep your personal information for a certain period of time for different purposes, the details are provided below:

(1)     Account Closure

If you choose to close your CakeResume account, your personal information will generally stop being visible to others on our Services within 24 hours. We generally delete closed account information within 30 days of account closure, except as noted below.

We retain your personal information even after you have closed your account if reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement, or fulfill your request to "unsubscribe" from further messages from us. We will retain de-personalized information after your account has been closed.

Storage beyond the contractual relationship is based on our legitimate interests according to Art. 6 para. 1 lit. f GDPR.

Please note that third-party services, such as search engine results, may still continue to display your profile until the cache is updated.

(2)     Storing and Transferring Information Internationally 

CakeResume provide global services. The personal information that we collect from you, as described in this Privacy Policy, could be made accessible from, transferred to, or stored in countries which may not have the same data protection laws as the country in which you initially provided the information. We will put appropriate safeguards in place to make sure that these transfers comply with GDPR.

When your personal information is transferred internationally, we establish and implement appropriate contractual, organizational, and technical measures with them. This is done by putting in place Standard Contractual Clauses as approved by the European Commission, by examining the countries to which the personal information may be transferred, and by imposing specific technical and organizational security measures.

(3)     Users under 16

We may only collect and process personal information of individuals who can lawfully use the Services without parental consent. When necessary, users under the age of 16 will be told not to submit any personal details. We will make every effort to delete any details of such users where a parent or guardian has informed us that these details have been collected.

 

5.      Your Rights

You have rights to access, delete and other choices to your personal information, as the detail provided below, by making a request to us through contacting under section “7. Contact Us” of this Policy.

(1)    Right of Access to Data: You have the right to request us for what and how your personal information be collected and processed by us.

(2)    Right to Erasure: You can ask us to erase or delete all or some of your personal information, but you may therefore not be able to utilize or access all the functions in our Services.

(3)    Right to Change or Correct Data: You can edit some of your personal information through your account. You can also ask us to change, update or fix your personal information in certain cases, particularly if it’s inaccurate.

(4)    Right to Object:  You can ask us to stop using all or some of your personal information that we process on the legal basis of point (e) or (f) of Article 6(1) of GDPR, unless we can demonstrate compelling legitimate grounds for the processing override your interests, rights, and freedoms or for the establishment, exercise, or defense of legal claims.

(5)    Right to Restriction of Processing: You can ask us to limit our use of all or some of your personal information, but you may therefore not be able to utilize or access all the functions in our Services.

(6)    Right of Data Portability: You can ask us for a copy of your personal information and can ask for a copy of personal information you provided in machine readable form and have the right to transmit the information to another controller without hindrance from the controller to which the personal information have been provided.

(7)    Non-Discrimination: You have the right not to receive discriminatory treatment for exercising any of the rights described above. 

Please note that there are circumstances in which complete erasure or ceasing to process your information will not be possible for operational and legal reasons. This may include if you remain a customer for whom we need to provide Services, or if you wish us to no longer contact you for marketing purposes. In this case we may need to retain some of your information to facilitate this request by, for example, keeping you on a “do not contact” or suppression list. 

 

6.      CCPA and Other Law Related to Personal Data Protection 

(1)     California Consumer Privacy Act ("CCPA”)

In addition to the rights mentioned above, if you are a California resident, you have some additional rights under the CCPA, which include being informed if any of your personal information that has been “sold”.

A.     Note about “Sales

We do process personal information of users to certain contractually affiliated third-party companies and service providers for purposes documented in this Privacy Policy, which is defined as a “sale” of personal information under the CCPA. However, we do not “sell” personal information as most people would typically understand that term

B.      Right to Opt-in and Opt-out

You also have the right to opt out of the future “sale” of your personal information to third parties. If you have any questions or want to exercise your rights, you may contact us online.
